It is one of the most elegant uses of the whole model, and at the same time the one with the most half-truths in circulation: trading US stocks and options through your own LLC. The truth is better than the rumors, but it has more than one floor, and if you only know the first, you pay on the next. First, the obligatory sentence: this is tax education, not investment advice.
Floor one: the US, and this is where it gets good
The basic rule surprises even experienced investors: capital gains of nonresident aliens on US securities are generally tax-free in the US. No capital gains tax on your Apple gains, no US filing duty just because of the trading, as long as you are not physically present in the US for 183 days or more in the year; the IRS explains the rules in Publication 519. Your transparent LLC does not change this for the worse: it passes the exemption through to you. What the US does tax is dividends: 30 percent withholding tax, often 15 with your country of residence's treaty; you know the full mechanism including the W-8 form. Growth and options strategies therefore run almost free of withholding tax, while dividend strategies pay the rate of their residence choice.
Why trade through the LLC at all?
If the US exemption also applies privately, why the company? Four practical reasons: broker access and stability (entity accounts at brokers like Interactive Brokers are often the more reliable route for people with an exotic residence than private accounts that act up when you change address), continuity when you move (the LLC's account stays the same when you change countries), liability and asset architecture (trading capital cleanly separated from operating risk, ideally even in a separate second LLC), and professionalization (bookkeeping, withdrawal discipline, later investors or a family structure). The LLC does not make trading more tax-free; it makes it more robust.
Floor two: your country of residence, and this is where everything is decided
The passed-through gains land with you for tax purposes, and your country of residence decides what happens to them. The territorial question has a subtlety traders need to know: some territorial countries treat actively earned trading income more strictly than passive foreign income, and the line between investor and professional trader runs differently from country to country. In the classic zero-tax and territorial countries on our list, private investors and moderate traders usually come out cleanly at zero; if you trade at high frequency or live from trading, clarify how your destination country classifies it beforehand. And the permanent establishment rule applies to traders like everyone else: if you visibly and permanently run your trading LLC from a high-tax country, you have invited the profits there too.
The trader setup in one formula
Capital gains: US-free. Dividends: a treaty matter. Overall tax: a residence matter. Robustness: an LLC matter. Four short sentences, and you know more than ninety percent of the forums.
