Many digital entrepreneurs, YouTubers and content creators monetise their content through a US LLC. The model sounds tempting: a disregarded entity LLC pays no tax in the United States as long as its owner is not a US person, meaning not a US citizen, not a green card holder and not tax resident in the United States.

But what does that mean in concrete terms for YouTube income that runs through an LLC? Is there US withholding tax? What about your tax status in your country of residence? And does the model also work for digital nomads without a fixed residence, or for expats in Dubai?
We look at the topic in practical, well-founded terms.
LLC + YouTube: the basic model
If you run a US LLC that is treated as a disregarded entity (in other words, tax transparent), the profit flows directly to you for tax purposes. That means:
-
The LLC itself pays no US tax.
-
For tax purposes, the income counts as earned directly by you.
Important: This tax exemption only applies as long as you have no permanent establishment (PE) in the United States and are not considered engaged in a trade or business in the US (ETBUS) under US tax law. If your LLC is classified as actively operating in the US, for example through employees, fixed facilities or US contracts, full US tax liability can arise.
The decisive point: the source of the income determines whether US withholding tax is deducted.
Why Google asks for the W-8 form
As a US company, Google is legally required to check whether US withholding tax applies to payments to foreign persons or companies. Without the correct form, Google has to assume a tax liability exists and by default withhold 30%.
So the W-8 form is your proof to Google (and indirectly to the IRS) that:
-
you are not taxable in the United States,
-
you are tax resident in a particular country (possibly with a tax treaty),
-
your income is not income subject to US withholding tax.
Without a correctly submitted form, Google has to deduct the 30% purely as a precaution, even if you do not actually owe any US tax.
Good to know: In practice, Google does not ask you to upload a PDF form. Instead, Google uses a simplified online questionnaire in which you enter the relevant information step by step. Google then automatically generates an internal W-8BEN profile from it.
Overview: the most important W-8 forms
There are several versions of the W-8 form, depending on who receives the income and which structure is involved:
-
W-8BEN: For individuals (for example you, as a person who owns an LLC). The most common form.
-
W-8BEN-E: For entities, for example if your LLC is held by a foreign corporation.
-
W-8ECI: For income effectively connected with a US permanent establishment; rarely relevant in our case.
-
W-8EXP: For certain tax-exempt organisations (for example foundations).
-
W-8IMY: For so-called intermediaries and partnerships (for example multi-member LLCs with several members).
For the vast majority of YouTubers with a US LLC, the W-8BEN is the relevant form, or the W-8BEN-E where a company is the owner.
AdSense income: US source or not?
Google (or YouTube) pays AdSense income to the LLC or individual stored in the backend. Google relies on the information in the W-8BEN you submitted once.
The decisive points:
-
If you produce your videos outside the United States, the income generally counts as foreign service income.
-
From the US perspective, such income is not taxable in the United States and is not subject to US withholding tax, even without a tax treaty.
-
The condition: you have submitted a correctly completed W-8BEN.
Under US tax law, what counts is where the service is performed, not where the audience is. If you produce your videos in Dubai, Bangkok or Lisbon, the income is "foreign" from the US perspective.
YouTube Premium: the special case
The one exception: YouTube Premium income.
Google generally treats it as royalties. Why?
-
Because paying YouTube users in the United States "use" your content,
-
and you implicitly grant Google a right to use your intellectual property (your videos).
Under IRC §861(a)(4), licence use of this kind in the US counts as US-source income and is subject to 30% withholding tax unless you have a tax treaty with the US.
This withholding tax only affects the Premium share of your income, usually a small percentage. But it is important to know if you live in a country like the UAE.
A key condition: a correctly completed W-8BEN
To avoid withholding tax on AdSense, you need a correct W-8BEN. The rules:
-
If you as an individual own the LLC (single-member LLC), you personally fill in the W-8BEN, not the LLC.
-
The LLC is tax transparent: the IRS looks "through" it.
-
Line 1 of the form takes your name, not the LLC's.
-
The LLC can optionally be mentioned on line 7 ("Reference number").
If, on the other hand, a corporation owns your LLC, the W-8BEN-E applies.
Watch out: the tax trap in your country of residence
Even if your US LLC is tax transparent in the United States, under certain conditions it can count as a permanent establishment or tax-relevant entity in your country of residence. That means:
-
The local tax authorities (for example in Dubai or Cyprus) could argue that the LLC's place of management is with you.
-
In that case, the LLC's entire profit would be taxable in your country of residence.
Especially in countries like the UAE, where economic substance and reporting obligations are increasing (for example the Economic Substance Regulations and Corporate Tax), you should get expert advice. A wrong assumption can lead to painful tax claims.
Our tip: have it checked in which country your LLC could be considered tax resident. Only then can you make a sound decision about whether the model is worth it for you.
The alternative: residence in a low-tax country with a tax treaty
Instead of operating as a digital nomad without a tax residence, it can be strategically smarter to establish a fixed tax residence in a treaty country with a low effective tax burden. Examples:
-
Malta: With non-dom status, you can receive foreign income such as AdSense tax free as long as it is not remitted to Malta.
-
Cyprus: With non-dom status and IP box rules, an effective tax burden of under 5% is achievable.
In both cases you benefit from a valid double tax treaty with the United States and can fill in the W-8BEN cleanly and legally.
For many people, that is the better route than the tax no-man's-land of digital nomadism.
A US LLC for YouTubers is not always tax free
The "LLC + YouTube" model can be very efficient if:
-
you live in a country with a tax treaty (optional, but helpful for YouTube Premium),
-
you are actually tax resident there,
-
the work (content creation) takes place outside the United States,
-
you have filled in the W-8BEN correctly,
-
and you are aware that YouTube Premium can count as a royalty payment.
For nomads without a tax residence, people in low-tax countries without a tax treaty (for example Paraguay, Panama) or expats with an uncertain tax status, a US LLC can be disadvantageous for tax purposes.
