How Long Does LLC Formation Really Take? Honest Answers Instead of 24-Hour Promises

What really drives how long a US LLC formation takes: the register, the season, the EIN and the account. And why 24-hour promises are just advertising.

Published: August 26, 2025

"Your LLC in 24 hours!" says the ad. And three weeks later you are still sitting there without a bank account, wondering what went wrong. Time for an article no formation portal would write: what really determines how long an LLC formation takes, and which timeline you should realistically plan for.

Formed is not the same as ready for business

The most important misconception first: "LLC formed" and "business ready to go" are two different events. Registration with the state is only the first of four steps:

  1. Registration with the state. The actual filing. Depending on the state, the procedure and the season, it takes anywhere from hours to several weeks. Many registers offer expedited processing for an extra fee; official websites such as that of the Wyoming Secretary of State list the current processing options.
  2. The EIN, your US tax number. Without it: no account, no tax return, no Stripe. For foreign founders without a US Social Security Number, the application goes through the IRS, and this is the real bottleneck: processing for foreign owners regularly takes several weeks, however quickly your state registered the company.
  3. The business account. Banks and fintechs look more closely at foreign owners, ask for documents and come back with questions. With complete documents it moves quickly; with gaps, it doesn't move at all.
  4. The paperwork in detail. Operating Agreement, an apostille where needed, translations: everything banks, platforms or your country of residence will want to see later.

Why 24-hour ads don't lie (and still mislead)

The 24 hours almost always refer only to step 1, in a fast state, with expedited filing. That is not a lie, but it misleads, because it leaves out the steps that actually matter. An LLC without an EIN and an account is a piece of paper. Our advice: plan in weeks, not hours, and be pleased if it goes faster. Anyone who promises you otherwise is selling you the register stamp, not a business that is ready to operate.

A second factor hardly anyone mentions: the season. At the start of the year, applications pile up at many registers, because half of America wants its company formed on 1 January. The same formation that goes through quickly in August can take noticeably longer in January.

What you can speed up yourself

The good news: the biggest delays do not happen at the authorities but with incomplete documents. What you can contribute: a clear company name with alternatives, complete and consistent owner details (spelled exactly as in your passport), a valid ID scanned in good quality, and quick replies to questions. On our side, the filing, the EIN application and the account preparation run in parallel rather than one after the other, because we know the order of the dependencies. Exactly what is in the package is on the services page.

Which state, if speed matters?

Register speed differs from state to state, but it should never be your main criterion: you are forming a company for years, not for its first week. Choose the state for privacy, asset protection and image; the state atlas gives you the overview. If two states are equally good for you, take the one with the simpler register; we will tell you honestly when you order.

The realistic timeline

This is what the honest process looks like with us: you order online, we usually start the filing the same or the next business day, and in parallel we prepare the EIN application and the account opening. For the complete ready-to-operate package, from order to usable account, think in weeks. We give you more precise information about your state and the current situation at the register when you order, and we tell you how things actually are right now, not how they would sound good in an ad.
